Warning Required: Suntanning Preparations Without Sunscreen
This article applies to suntanning preparations without sunscreen sold in the United States.
Any product marketed as a suntanning preparation but which does not contain sunscreen must have a warning statement.1
Tanning preparations without sunscreen include products such as gels, creams, lotions, or oils which are intended to assist in the tanning process by moisturizing or conditioning the skin but which do not contain sunscreen. It also includes products used to actually change the color of the skin (such as spray or lotions tanners) – again, without sunscreen. It does not include products which are intended to provide sun protection (sunscreens).
Warning Statement
The warning statement must say:
Warning - This product does not contain a sunscreen and does not protect against sunburn. Repeated exposure of unprotected skin while tanning may increase the risk of skin aging, skin cancer, and other harmful effects to the skin even if you do not burn.
Warning Statement Requirements
The warning statement must be prominent and conspicuous, compared to other words or text on the label and be well contrasted with the background. The text must be at least 1/16 of an inch high (see Labeling: Measuring the Text Size).2 The warning statement does not need to be on the principal display panel; it may be on the back or side of the package so long as it is readily visible.
